Herbert Jones is accused of treating an elf like a ho-ho-ho.

Tis the season to be jolly, and for one mall Santa in Hanover, Massachusetts, jolliness comes in the form of accusations of being sexually inappropriate.  A 62-year-old man named Herbert Jones was playing Santa at a photo booth at the Hanover Mall when at about 5:30 during the day, the police came to the mall and arrested him.  The charge?  Santa was arrested for pinching an elf on the butt.  The elf–an 18-year-old girl–worked alongside Jones at the Cherry Hill Photo station in the mall.

Of course, there are two sides to every story.  The girl says that Jones pinched her on the backside and made a comment like, ““I wish you were a few years older and I was younger.”  After the woman took a break and told the manager, there was a confrontation with Jones that devolved into yelling and general Santarchy.  Meanwhile, Jones says that while he was on his Santa throne, the woman brushed against him and he moved his hand away from her hindquarters.  As for the comment, Jones says it was taken out of context, as he was commenting that he would have lived his life differently.  As for the only semi-impartial party in this, the manager says the 18-year-old elf was upset after being questioned about missing money.

Jones was released on $1000 bail and barred from both playing Santa this year and being at the Hanover Mall.  The girl playing the elf quit her job on the spot after the argument.  And Grandma?  Well, she’s still going to get run over by a reindeer.
