If you thought food lawsuits occurred only over restaurant themes, then think again. Two vineyards are battling in court over the right to be Mommy’s new little helper and to reflect that idea on their label. Clos Lachance Wines, a California-based vineyard that makes Mommyjuice wine, is suing the New Jersey distributor behind Mommy’s Time Out wine over the right to use the word Mommy in their wine name. That’s right, it’s a wine-fueled brawl for the right to be Mommy to a generation of drinking mothers.
“Mommy is a generic word that they don’t have a monopoly on,” argues Clos Lachance lawyer KC Branch, who is representing the winery’s interests in the lawsuit filed in federal court in San Francisco.
This just goes to show you how hard it is to stand out in the current wine market. Every good name has been taken, and even if you can come up with a great name, it’s hard to get attention to your product in a very crowded market. That’s where Flasq Wines has made a splash; they’ve got a cool name, cool packaging, and a great gimmick behind their wine.
