Talk about your weird lawsuits! Internationally famous chocolate company Hershey’s and little-known iPhone app development firm Hottrix are embroiled in a copyright lawsuit battle over fake chocolate milk. That’s right, Hershey’s introduced a free chocolate milk app that allowed users to drink digital chocolate milk via a red-and-white straw, which Hottrix claims infringes on their $3 app, iMilk. Weirdly enough, Hottrix also recently settled a similar lawsuit against Coors over a fake beer app.
Of course, Hershey’s maintains that their app is completely different from Hottrix, thanks to the straw. Said Hershey’s legal documents, “Unlike the Hottrix application, the Hershey’s Chocolate Milk iPhone application ‘milk’ cannot be ‘drunk’ from the iPhone by tipping the phone (which is the only mechanism for drinking the milk in the Hottrix application), but can only be ‘drunk’ by use of the virtual straw.” Meanwhile, Hottrix maintains that Hershey’s free app has cost them $12 million dollars in downloads and damage to the company’s intellectual property.
All this over some fake milk. Yeesh.
